1. Acceptance of terms

By accessing or using the PixelBroker website at pixelbroker.io (the "Site"), you agree to these Terms of Service. If you do not agree, please do not use the Site.

These Terms apply only to the website. The PixelBroker mobile app is governed by its own separate Terms of Service.

2. What PixelBroker is (and what it isn't)

PixelBroker is an informational website and public catalog of retro video games. It aggregates publicly available data from third-party sources, including market price estimates from PriceCharting and game metadata and cover art from TheGamesDB.

PixelBroker is not:

• A financial service or investment platform
• A broker, dealer, or marketplace
• A source of financial advice
• A direct sales channel for video games

The prices shown on the Site are estimates based on public third-party data. They may not match real-world transaction prices on platforms such as eBay. Before making any buying or selling decision, verify current prices on the actual marketplace where the transaction will take place.

3. Use of the service

You may use PixelBroker for personal, non-commercial purposes: browsing the catalog, looking up game prices, and reading information about the project and its mobile app.

The following uses are not permitted:

• Automated scraping or mass downloading of the catalog
• Excessive or abusive requests to the backend that could degrade the service for other users
• Attempts to bypass, probe, or compromise the security of the Site or its API
• Republishing or redistributing the Site's data, design, or branding without prior written permission

We reserve the right to block IP addresses or otherwise restrict access if any of these rules are broken.

4. Intellectual property

The "PixelBroker" name, the Site's design, the logo, the source code, and the original written content are property of the project's operator.

Game cover art, screenshots, titles, and metadata shown on the Site are the property of their respective owners (publishers, developers, and data providers such as TheGamesDB and PriceCharting). They appear on the Site for informational and identification purposes only. Their inclusion does not imply endorsement, affiliation, or sponsorship.

5. No financial advice & disclaimer of liability

PixelBroker is a tool for retro game collectors. It is not a financial product. Specifically:

• For collectors, not traders: the Site is built for cataloging and tracking, not for speculation or financial decision-making.
• Prices are estimates: loose, complete-in-box, and new/sealed values are aggregated from third-party sources. They may not reflect real market liquidity, exact transaction values, or guaranteed future worth.
• Zero liability: you are solely responsible for your own buying, selling, and collecting decisions. The operator assumes no liability for financial losses, missed opportunities, or other damages incurred from relying on the data, trends, or alerts shown on the Site.

The service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, including but not limited to warranties of accuracy, completeness, availability, or fitness for a particular purpose.

6. Limitation of liability

To the maximum extent permitted by applicable law, the operator of PixelBroker is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from or related to your use of the Site, including without limitation damages for loss of profits, data, or other intangible losses.

7. Third-party links

The Site may link to third-party websites (Google Play, official publisher pages, and similar). The operator is not responsible for the content, terms, or privacy practices of those external sites. Affiliate-link disclosures specific to the eBay Partner Network are covered in section 12.

8. Mobile app is governed separately

The PixelBroker mobile app is a different product and is governed by its own Terms of Service, available within the app and on its Google Play Store listing. These website Terms do not apply to the mobile app, and vice versa.

9. Changes to these terms

We may update these Terms of Service from time to time. The "Effective" date at the top of this page reflects the current version. Material changes will be announced visibly on the website. Continued use of the Site after changes are published constitutes acceptance of the updated Terms.

10. Governing law

These Terms are governed by the laws of Spain. Any dispute arising from or related to the Site or these Terms shall be subject to the jurisdiction of the courts of Catalonia (Spain), unless mandatory consumer-protection or other laws require a different jurisdiction.

12. Affiliate Disclosure

PixelBroker is a participant in the eBay Partner Network, an affiliate program designed to provide a means for sites and applications to earn fees by linking to eBay. When you click on external links to eBay listings from within the app or notifications, we may receive a small commission if you make a purchase. This does not affect the price you pay nor influence which listings we show; all listings are sourced and ranked using the public eBay Browse API.
